Terms of Service

Plain-English summary: GoraAdv is a route planning tool for offroad motorcyclists. Use it to plan — not to navigate. Routes are based on OpenStreetMap data and may be inaccurate. Free use is unrestricted for planning. PRO is a paid subscription billed by Lemon Squeezy. You can cancel anytime. We don't take responsibility for accidents or terrain conditions. German law applies.

1. Scope and Parties

These Terms of Service ("Terms") govern the use of the GoraAdv website and route planning service available at goraadv.com ("Service"). By using the Service, you agree to these Terms.

Payment Processing — Lemon Squeezy as Merchant of Record

Payment for the PRO subscription is processed by Lemon Squeezy (a Stripe company), who acts as the Merchant of Record for all transactions. When you purchase a PRO subscription, you enter into a payment contract with Lemon Squeezy directly, governed by Lemon Squeezy's Buyer Terms. GoraAdv is the licensor and service provider — these Terms govern your right to use the software and service, not the payment transaction.

2. Description of the Service

GoraAdv is an offroad motorcycle route planning platform. It uses OpenStreetMap map data and a custom routing algorithm to generate routes that prioritise unpaved roads, dirt tracks and gravel paths over tarmac.

The Service provides:

  • Automated offroad route calculation between user-defined points
  • Route visualisation on an interactive map
  • Route statistics (distance, elevation profile, terrain breakdown by type)
  • GPX file export for use with GPS devices and navigation apps (available on applicable tiers)
  • Optional route saving to a user account
  • Community route sharing features

The Service is provided "as is" as a planning tool. It is not a real-time navigation system. See Section 11 for the full safety disclaimer regarding route data.

3. Registration and User Accounts

The core planning features of GoraAdv can be used without registration, subject to usage limits for unregistered users (see Section 4). To save routes or access registered-user features, you must create a free account.

When registering you must:

  • Provide an accurate email address and a chosen username
  • Choose a password of at least 8 characters
  • Be at least 16 years of age

You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at info@goraadv.com if you suspect unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false registration information, or are used for abusive or fraudulent purposes.

4. Service Tiers and Features

GoraAdv is offered in three tiers. Features and limits may be updated over time; the current limits are always shown on the Pricing page.

Daily route limits reset at midnight UTC. Distance limits are calculated as straight-line distance between start and end point and serve as an approximate gate — actual routed distance may differ.

Alpha / Beta notice: While GoraAdv is in its alpha or beta phase, all features may be available under modified limits. These temporary alpha/beta limits do not form part of the contractual service description and will be updated when the service reaches general availability.

5. PRO Subscription — Billing and Auto-Renewal

5.1 Subscription Plans

GoraAdv PRO is available on two billing cycles:

  • Monthly: €5.00 per month, billed on the same date each month.
  • Annual: €40.00 for the first 12-month period, billed upfront.

All prices are inclusive of any applicable taxes. VAT handling is managed by Lemon Squeezy as Merchant of Record.

5.2 Auto-Renewal

Subscriptions renew automatically unless cancelled before the renewal date (see Section 6 for cancellation).

  • Monthly plan: Renews each month on the billing anniversary date. The contract is indefinite in duration from the start, cancellable with one (1) month's notice.
  • Annual plan: After the initial 12-month paid period, the subscription automatically continues as an indefinite monthly contract at the then-current monthly price, cancellable at any time with one (1) month's notice. It does not automatically renew for another 12-month fixed term.

You will receive an email reminder from Lemon Squeezy before each renewal. Payment is charged to the payment method on file with Lemon Squeezy at the start of each billing period.

5.3 Failed Payments

If a payment fails, Lemon Squeezy will retry according to their standard dunning process. If payment is not collected, PRO access will be suspended and your account will revert to the Free tier. Saved routes exceeding the free tier limit will be preserved for 30 days to allow reactivation before being subject to removal (see Section 8).

5.4 Price Changes

We reserve the right to change subscription prices. You will be given at least 30 days' notice of any price increase by email. If you do not cancel before the new price takes effect, continued use of the Service constitutes acceptance of the new price. Price increases will not take effect within the first four months of a monthly billing cycle under §309 No. 1 BGB.

6. Cancellation

6.1 How to Cancel

You may cancel your PRO subscription at any time through:

  • Your GoraAdv account page — a cancellation option is available under Account Settings once PRO is active. This option is accessible without needing to contact us (as required by §312k BGB).
  • The Lemon Squeezy customer portal — accessible via the link in any billing email or receipt from Lemon Squeezy.
  • Email — send a cancellation request to info@goraadv.com. We will confirm cancellation within 2 business days.

6.2 Effect of Cancellation

Upon cancellation:

  • Your PRO access continues until the end of the current paid period (the month you already paid for, or the remainder of the annual period).
  • No partial refund is issued for the unused portion of a paid period, except as required by law or in cases covered by the right of withdrawal (Section 7).
  • After the paid period ends, your account reverts to the Free tier. Saved routes exceeding the free tier limit are subject to the process described in Section 8.

6.3 Notice Period

To avoid being charged for the next billing period, you must cancel at least one day before your next renewal date. We recommend cancelling with a few days' buffer. The exact renewal date is visible in your account and in Lemon Squeezy billing emails.

7. Right of Withdrawal (Widerrufsrecht)

As a consumer in the European Union, you generally have the right to withdraw from a distance contract within 14 days without giving any reason (§312g BGB in conjunction with Art. 246a EGBGB).

7.1 Waiver of the Right of Withdrawal for Digital Services

GoraAdv PRO is a digital service (§312 (1a) BGB). Under §356(5) BGB, the right of withdrawal expires when the service has been fully performed, provided that:

  1. You expressly consented to the commencement of performance before the expiry of the withdrawal period, and
  2. You confirmed your knowledge that your right of withdrawal expires upon full performance of the contract.

At the point of purchase in the Lemon Squeezy checkout, you will be asked to confirm both of the above conditions via a mandatory, separately presented checkbox before completing your order. This confirmation is a prerequisite to completing the purchase.

7.2 Consequence

If you provide the consent described above at checkout, and the service begins immediately upon purchase, your right of withdrawal expires once the service has been fully performed (i.e., at the end of your first subscription period). You will receive written confirmation of this waiver in your order confirmation email.

7.3 Right of Withdrawal Before Service Commencement

If you did not consent to immediate commencement of service, or if the service has not yet commenced, you retain the full 14-day right of withdrawal from the date of the contract. To exercise this right, send an unambiguous declaration (e.g., by email) to info@goraadv.com. We will process refunds within 14 days of receiving a valid withdrawal declaration, using the same payment method used for the original payment where possible.

8. What Happens When a Subscription Lapses

When your PRO subscription ends (through cancellation, non-renewal, or payment failure):

  • Your account immediately reverts to the Free tier.
  • PRO-exclusive features (additional waypoints, long-distance routing above 300 km) are no longer available for new route calculations.
  • Previously saved routes that exceed the free tier's save limit (3 routes) are not immediately deleted. You have a 30-day grace period to export, download, or delete routes manually, or to reactivate PRO.
  • After the 30-day grace period, if your saved route count still exceeds the free tier limit, routes exceeding the limit will be deleted, starting with the oldest routes first. You will receive an email warning at least 7 days before any deletion.
  • Your account, registration data, and routes within the free tier limit are retained until you request account deletion.

Route data associated with your account is subject to the data retention terms described in the Privacy Policy.

9. License Grant

Subject to your compliance with these Terms and (for PRO features) payment of the applicable subscription fee, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the GoraAdv Service for your personal, non-commercial route planning purposes.

This licence does not include the right to:

  • Copy, reproduce, or redistribute any part of the Service or its underlying software
  • Reverse engineer, decompile, or attempt to extract the source code of the routing algorithm or any backend service
  • Resell, sublicense, or commercialise access to the Service or routes generated by it
  • Use automated tools (bots, scrapers, crawlers) to generate routes or extract data in bulk

GPX files downloaded from GoraAdv may be used freely for personal navigation and shared with riding companions for trip planning purposes.

10. User Obligations and Acceptable Use

You agree not to use the Service to:

  • Circumvent or attempt to bypass usage limits, authentication, or access controls
  • Upload or transmit content that is unlawful, harmful, abusive, or infringes third-party rights (when using community upload features)
  • Deliberately generate misleading or fabricated routes for upload to the community section
  • Attempt to access other users' accounts or data
  • Use the Service in any way that disrupts or damages the platform or its infrastructure

We reserve the right to suspend or permanently terminate accounts that violate these obligations, with or without prior notice depending on the severity of the violation.

11. Safety Disclaimer — Route Data

Important — please read before riding.

GoraAdv generates routes based on OpenStreetMap (OSM) data, which is community-maintained and may be incomplete, inaccurate, outdated, or missing entirely in some areas. Routes are provided for planning purposes only. They are not real-time navigation and are not a substitute for your own judgement and local knowledge.

Specifically:

  • Track conditions change. A route that appears passable on the map may be washed out, privately gated, overgrown, or otherwise impassable when you arrive. Map data does not reflect real-world weather events, seasonal closures, or recent changes to land access.
  • Legal access. GoraAdv attempts to exclude tracks tagged as legally restricted in OSM (private land, no-entry, motor vehicle prohibitions), but tagging is inconsistent and may not reflect current local regulations. You are responsible for verifying legal access before riding any track.
  • Terrain difficulty. The tier system (T1–T5) is based on OSM tags and may not accurately reflect real terrain difficulty. A T2 track can feel like a T1 in wet conditions or at altitude. Always assess conditions on the ground.
  • Elevation and distance figures are derived from available map data and are approximate. Actual elevation gain and distance may differ.
  • Emergency access. Never rely solely on GoraAdv to plan a route in areas where rescue is difficult. Always carry paper maps, a GPS device with offline maps, and adequate supplies for unexpected diversions.

By using GoraAdv, you acknowledge that riding offroad carries inherent risks and that you assume full responsibility for your riding decisions. GoraAdv is a planning tool — the responsibility for safe and legal riding remains entirely with you.

12. Service Availability and Modifications

We aim to keep the Service available but do not guarantee uninterrupted or error-free access. Planned maintenance will be announced where practical. Unplanned downtime may occur.

We reserve the right to modify, extend, or discontinue features of the Service at any time. Changes to features that materially reduce the service level for PRO subscribers will be communicated with at least 30 days' notice. If a material reduction in service is made, you have the right to cancel and will receive a pro-rata refund for the unused portion of your paid period.

Country coverage (available routing regions) will be expanded over time. Coverage depends on OSM data quality and our tile build process. We do not guarantee availability of specific countries or regions.

13. Liability

13.1 Liability for Intent and Gross Negligence

We are fully liable for damages caused by our intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), and for damages resulting from injury to life, body, or health, regardless of the degree of fault. This liability cannot be limited or excluded.

13.2 Liability for Simple Negligence

For simple negligence (einfache Fahrlässigkeit), we are only liable for breaches of cardinal obligations — those whose fulfilment is essential to the proper performance of the contract and on whose compliance you may regularly rely. In such cases, our liability is limited to damages that were foreseeable and typical at the time the contract was formed.

We are not liable under simple negligence for:

  • Loss of data, unless caused by a failure of a cardinal obligation
  • Indirect damages or loss of profit
  • Damages arising from the use of route data generated by the Service in actual riding situations

13.3 Route Data — No Liability

GoraAdv is a planning tool. We expressly exclude liability — to the maximum extent permitted by applicable law — for any physical injury, property damage, financial loss, or other damage arising from:

  • Reliance on route data, distances, or terrain classifications generated by the Service
  • Inaccurate, outdated, or missing map data from OpenStreetMap
  • Track or road conditions at the time of riding that differ from map data
  • Legal access violations based on inaccurate OSM tagging

13.4 Statutory Liability

Mandatory statutory liability under German law (including the German Product Liability Act — Produkthaftungsgesetz) remains unaffected by the above limitations.

14. Intellectual Property

The GoraAdv platform, its routing algorithm, interface design, branding, and original content are the intellectual property of Felix Witte and are protected by German and EU copyright law.

Map data displayed on GoraAdv is sourced from OpenStreetMap contributors and is made available under the Open Database Licence (ODbL). Credit: © OpenStreetMap contributors.

User-generated content uploaded to the community section (e.g., GPX tracks) remains your intellectual property. By uploading, you grant GoraAdv a non-exclusive, royalty-free licence to store, display, and make available that content to other users of the platform, for as long as it is hosted on the Service.

15. Data Protection

The processing of personal data in connection with the Service is governed by our Privacy Policy, which forms part of these Terms. By using the Service you acknowledge that you have read and understood the Privacy Policy.

In summary: we collect only what is necessary to operate the Service. We do not sell data or use advertising trackers. Payment data is processed exclusively by Lemon Squeezy under their own security controls and privacy policy.

16. Changes to These Terms

We may update these Terms to reflect changes in the Service, applicable law, or business operations. Changes that materially affect your rights will be communicated by email (to registered users) and by a notice on the website at least 30 days before they take effect.

If you do not agree to updated Terms, you may cancel your account or subscription before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

For users on a paid PRO subscription, changes that materially reduce the service will be subject to Section 12 (Service Modifications).

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

If you are a consumer resident in the EU, the mandatory consumer protection provisions of your country of residence also apply, to the extent they provide greater protection than German law.

17.1 Jurisdiction

For disputes with consumers, the place of jurisdiction is the consumer's place of residence or, at the consumer's choice, the registered address of GoraAdv (Bochum, Germany). For disputes with non-consumers, exclusive jurisdiction lies with the courts of Bochum, Germany.

17.2 EU Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) for consumer disputes at ec.europa.eu/consumers/odr. Our email for ODR purposes is info@goraadv.com. We are not obliged to participate in dispute resolution before a consumer arbitration board and do not do so voluntarily, but we will always try to resolve complaints directly — email us first.
